Wallpaper itself was stripped. It’s just the glue under the paint that’s the trouble.
Im in a bit of a jam and need to raise about 2K ASAP. I know Im reaching here, but does anyone know of any way I could use my house to make me some cash. I saw a property listing with “probate” listed in the disclosures. I would guess it means the owner died, and its sold by the estate but can you tell me more?
What is a probate sale like? is there anything I should know? do they go smoothly? Or is it something to be wary of (like a short sale)

My mom married a widower and they have both passed away.
mom been gone for 3 years and he has been gone for about 5 years
My Step Dad had previously married a lady that had 5 kids in a previous marriage. She died in the late 80’s.
When my Mom died i probated his and her will. He left everything to her and she left everything to me. When i tried to sell the house, the attorney said there are 5 other 50% owners. the community property laws then apparently gave everything to the children and not the spouse. Her kids got 50% of the house and the step Dad got 50% of the house. Sad because he bought and paid for it with his VA loan. Now the tax office because of the probabted will on record think I am the 100% owner and want all the taxes due from me and not the other 5. See the nightmare. I was told by the attorney that he contacted some of them and they didn’t want to sell the house and it could just rott. My apparent only way out was to petiton the court to do a force sale and take whatever I got. House is not worth much. say 30-35k.
Sad part was the real estate attorney that did the search wouldn’t take the case and my family lawyer wouldn’t touch it either. Help Me Please!!!!!!!!!
Sorry this is complicated to explain.I understand what you said but that is not what the attorneys told me. you are correct that step dad left everything to my Mom in will and her will left everything to me. i received the property in suscession of the prbabiting of the wills. I was going to do a quick cash sale of the house because i live out of town. The agents real estate attorney who did the title search after the inspection brought up the 5 kids and that they owned 50% of the house. My family lawyer who did the probating of the wills and the real estate lawyer both said that I have an undivided interest in the property. I would either have to get them to sign off or do a force sale. The real estate attorney said the 5 would not cooperate. i am not sure about the trumping part as at the time the lawyer said when the 5 kids mother who was married to my step dad first, died, the community property laws at the time gave everything to children not the spouse as it is today.

I believe I understand what you are saying and both my attorney who probated the wills of the step father and my mother and the real estate attorney who did the title search (Suppossedly) said the same thing. When the first wife died, her 50% ownership of the house went entirely to here 5 kids from the previous marriage. He kept his original 50% of the house. So from what I am told there are 5 people who each own 10% and I have 50%. undivided interest. the first article I think says the same thing. thats the problem. the tax office just went by the will and says I am 100% and owe taxes whereas in fact I only own half. I contacted AFX titlesearch and am having the entire property title searched. Least then i can give something to the tax offic attorneys.
I guess the question is then how do i prove or disprove joint ownership with right of surviviorship. i contacted a national title search company to see what they come up with. They stated they could pove exactly who owned the property. I am going on what the real estate attorney said when I tried to sell the house shortly after probate. When he ran the title search for the insurance to sell he found there were 5 others and told me I had to have them sign off on selling the house. the only problem is he wouldn’t give me their names other than the last name. he said they refused and the place could sit and rott as far as they cared. He said I could petition the court to do a force sale of the property because of undivided interest. My attorney who probated the wills agreed with him. What makes me mad as I told the my attorney before probate the house was the only thing of value. if I can’t get it then it is not worth the time and money. He said there should be no problem.
But there was a problem apparently. To me the title search should have been done before probate by my attorney but I did not think of it until later. He said after that there was no way for him to have known and told me I would be better off letting it go back for taxes and sold at tax auction since the other 5 would not sell or buy my half interest. I tried to get both attorneys to send the letters and do a force sale two years ago but neither one would accept the task. What the real estate attorney said he didn’t know why they didn’t want to sell and that when the force sale was done and attorney fees, court costs and sale fees that no one would get any money. Figuritively speaking as the house is only worth about 30k and the force sale would be for about a cash price of maybe half that. If I had know about the other 5 I would never have probated the wills and got involved. I am out 5 grand in back taxes and attorney fees and I can’t legally do anything with the property.
I appreciate your assistance. It has weighed on me heavyily. I tried to do some good for my current family. I probabted both wills, paid the back taxes and then when I tried to sell it was oooops sorry. I just wish I would have known and think my attorney should have told me when I said the house is the only thing of value. If I dont get that then it is not worth the money. He should have told me to do a title search then to verify that the step dad had clear title then told me. I am waiting still for the title search to be completed. I know the house was purchased under his VA loan and i saw the paper saying the loan had been fulfilled with his name on it. Haven’t seen a deed. the county tax attorney took it off the docket and said that depending on when the step dads first wife passed could affect the title sucsession. I dunno realy. How do I safely rent a home from another state?
By · CommentsI am living in Utah right now.But I need to go back to TN and I don’t know the area or have friends or family there.Im in the process of looking for a place to rent over the internet.So the problem is how do I safely get a home rental from here in Utah.My husband will be coming home from Iraq in Dec. so I need to find a place for us.I can’t physically go there and check out the place because i have 2 baby boys and its just too expensive.
–Im afraid that if I send money or a check to the home owners over there in TN that it could turn out to be a scam or they don’t even actually own the home.The home owners said I can send a check for the security deposit and Oct rent to hold the place for me.Then there’s the other home with realtors who said I can send the deposit of $400.00 for them to hold it for only 2 weeks, and they said if I don’t like the place they will keep my money.
–I really need to get a place so I can have somewhere to go to when I get to TN.The hardest part right now is that since 90% of the soldiers from our base is coming home in December alot of the houses are being taken very quickly.Should I just tell the home owners I cannot give them any money till I am there in TN and risk having the place rented to someone else???

Differences in market appraisal- help?
By · CommentsMy fiance inherited some land from his father, and he is wanting to sell it. We have contacted a few real estate agents in the area and have received appraisals from two of them, but there are pretty big differences in the estimates they have quoted us.
One has given an estimate of $65,000-$70,000 and has said it will be offered at $70,000.
The other has given an estimate of $85,000-$95,000 and has said they will list it at $99,000.
The property itself is just a block of vacant bush land, it hasn’t got power or fencing etc. and it is located in a very remote area (Northern NSW, Australia- between Tenterfield and Casino). We aren’t expecting much from the sale, and are hoping that it will be a quick sale (his father died over 5 years ago and it’s taken this long to get everything finalised as far as deeds and just want it to be over and done with).
Due to the location there aren’t many real estate agents who we could use- perhaps one more. We’re worried about the differences in the appraisals and the quality of the information that has been provided to us. Whilst the people quoting $99,000 have sent us a folio with detailed information about other sales etc. The other people who quoted $70,000 have just sent us a contract (Sales Inspection Report and Exclusive Agency Agreement) with none of the accompanying information that we expected.
What should we do? Why is there such a large discrepancy between the two appraisals?
The last time a property sold in the immediate vicinity (the lots around the property) was in 2005- two were sold the same time. One was 48.58ha and had some sheds- it sold for $80,000. The other was 40.37ha and sold for $50,000.
Our property is 40.35H
There is currently one other property listed in the same town area- it is 48.56H with 3 dams and some fencing- it is listed with the $70,000 contract people- but I think it has been there for quite some time and if I am right and it is the property I remember looking at over a year and a half ago on the internet- it has been listed for a long long long period of time.
Some questions on a short sale property ?

1) Does the sellers lender(banker) has to approve first to list the property for short sale ?
2) Who picks the sellers realtor ? is the sellers lender ? or the seller himself ?
3) will the sellers realtor every contact the sellers lender for any info ?
4) Who decides as what price can they accept for the short sale property ? Is it the seller himself or the sellers lender ?
5) Does sellers banker ever give a $$ amount which the seller can accept for the short sale property ?
6) If the seller accepts a offer and then forwards the offer to his lender ? Does the bank usually say’s OK to that offer ?
7) Does the lender ever give a price to the seller before listing the property , so this way the seller know as what offers they can accept ? This way it helps the seller to cut down time, rather than seller accepting the offer and the afterwards he forwards to his bank and then bank rejects it.
Stripping Wallpaper?
By · CommentsI need help stripping wallpaper faster…I’m completely remodeling my kitchen and the 35 year old wallpaper is NOT coming down easily. I’ve got a roller thingy that scores it and a spray with something that dissolves the glue and a big spatula-style putty knife, but it’s not coming off…
We would like to paint our hallway and it currently has silk flower wallpaper on it. Can we just prime it and paint over it or do we have to stripe it. the thing is we don’t know what type of wall is underneath the paper.
-Is it possible to do in one day? What is the process?
we can’t soak the paper (which is anaglypta) as the water will ruin the board. have managed to get the top layer off but the liner underneath is still there, can we paint over this or does it need to be relined?
getting old wallpaper off?

We had a waterline leak in the home. As soon as we were notified we called a plumber and a water extraction company, then filed a homeowner insurance claim. Everything was dried out and we are waiting to receive the money from the insurance company to do repairs. In the meantime and leak occurred in another area of the home. Same deal, called the plumber and water extractor and made another homeowners claim. We are waiting for the adjuster to go out for this claim. In the meantime our tenant has said she wants to break her 1 year lease after 6 months and is withholding this months rent until the problems are fixed. We have acted quickly to address the problems and the house has been habitable the whole time. What are my rights as a landlord when the tenants wants to break the lease and not pay because she has been inconvenienced?
I need to paint my walls after stripping off wallpaper?

Legal Advise Please?
By · CommentsMy mother has various mental health issues. Her Social Worker has suggested Sheltered Housing as mum is very vulnerable. To do this my mum will need to sell her house and use this money to pay her rent etc. The house is in a very poor state of repair as my mum has not allowed any work to be done for some time. Because of this I am concerned that she will only get a percentage of the true value. Is it legal for her to sell the house to me for a token amount say £100.00 which would then allow me to take a secured loan, renovate the property and sell at a future date which will generate more capital for my mum? This Sheltered Housing has been suggested by her Social Worker who feels the best solution is to get rid of the house as quickly as possible ie below market value.
The problem is a lot of the brown paint has come off in patches leaving white paint underneath. Is there a way I can easily remove the brown paint?
