Do I have to sign?

In early Feb I had a mediation conference in regards to my children and property settlement. I was in my solicitors office, my childrens’ dad was in his and the mediator was via phone. He was the one who left because he cheated on me and decided to be with her. He managed to get extra days per month with the kids and I’m supposed to pay him out for the house to be solely in my name. I dont agree with the amount and I’m concerned for my kids being with him for longer as I know they speak to them like rubbish (swears at and in front of them) and I suspects he does pot while he has them and drinks (but cant prove). They are forever telling the kids they will live with them instead of me and they both bad mouth me to our kids. He’s been in breach of what we did agree on already. I had legal aid for this matter, but do I have to sign if I dont agree?
He sent me a text message a couple of months back (when he left) that I can have the house – I still have it on my phone.
My oldest daughter (11) refuses to go there anymore and now cant as she is protected on an AVO I have against his gf. We werent actually married, just de-facto and have 5 kids together.
I cant afford to sell the house either

Bad conveyancing

My partner and i are buying a property and we have been quoted £650 for a solicitor via the estate agent ( so the solicitor is not independent). This amount is apparently fixed and if the sale does not go through we do not pay anything. I have asked around family and friends for a recommendation but everyone i know has had bad experiences with solicitors. Can anyone recommend a good conveyancing solicitor either in Bristol or in Wales and advise if this amount is a good quote, the house is £69,000 and freehold and we have no other property to sell???

I have separated from my husband of 12 years . . . . he has always been a very controlling type of person and vey critical of everything I wanted to do, of my fiends and of my family . . .

Finally after many years of being unhappy I finally told him how I felt . . . and didn’t that go down like a lead balloon . . . .He decided to move out and he left the kids with me . . .

I know that the easons we split ae many and complex and that he is not totally to blame and that I had my role to play in all of this too . . . but why does he feel that he needs to make all of this even moe unpleasant tan it already is??

He showed up at my place and i had to call the police as he was making threats and damaged wuite a bit of property. Because of this the police instigated an AVO . . . I wasn’t happy that we had to do this but could see that it did need to be done.

We had the hearing in court 2 days ago . . . I knew it was going to be unpleasant but didn’t think it would be as bad as it was. He was only there to slander and degragde me I am sure !! He bought up things that were not even elevant to what was happening. He even said that he was going to fight me for the kids.

I was so hoping that we were going to ba able to discuss these matters like esponsible adults but now with his behaviour at the courthouse I am afraid to do this . . . I had put in place so many things which were going to cost me in order for him to see the kids. He now lives 3 hours from us, and only has a vehicle which seats 2 ppl. I had my solicitor put in some interim orders which said I would drive every fortnight for him to see the kids . . . I am now thinking that I don’t want to have to do this.. . . (the orders have not yet gone b4 the court, but will be next week) My solicitor said that we can change the orders and he thinks that the judge will be fine with this as He (my ex) needs to do half of the travelling and organising !!

I feel like I have been so nice to him for so long . . . and all i get in return in grief . . . .

How do you deal with all the ugly lies . . . .and half truths . . . that are thrown around in the courtroom?!? and then walk away without being completely flattened?!?

Vancouver crowned break-in capital of North America

A new report has given Vancouver a dubious honour: the highest break-in rate of all major Canadian and American cities, nearly four times that of New York City.

Last year, Vancouver recorded more than 1,100 break-ins per 100,000 residents while New York City had just over 300.

The numbers are contained in the annual report by the B.C. Progress Board, which showed Vancouver had the second-highest combined violent and property crime rate among all major cities in Canada and the United States.

The annual report, which tracks a wide range of statistics on everything from exports to cancer rates to crime, and then ranks the province and Vancouver against other provinces, states and cities, has since 2001 become known for delivering good news and bad news.

After the report’s release on Thursday, Health Minister George Abbott noted B.C. once again ranks first for health outcomes in Canada.

“I’m very pleased by that. We know that British Columbians live longer than just about anyone else on the face of the earth.”

Fewer British Columbians are obese and fewer adults smoke than in any other Canadian province. And B.C. leads the country in life expectancy.

But it’s in the area known as ‘social condition,’ which measures everything from poverty to birth weights, that B.C. falls down with a ninth-place ranking among the 10 provinces.

According to the report, the most troubling social indicator was the 17.5 percent of British Columbians living below the low-income threshold, the second-worst ranking in Canada.

The report also notes the situation has not improved at all during the past decade.

And while crime rates have been improving, B.C. still lags behind the national average in all major categories.

Property crime in particular is a problem, NDP solicitor general’s critic Mike Farnworth points out.

“It shows B.C. has the worst rate of property crime in the country. I think it’s nothing for this province to be proud of.”

Despite the fact that crime rates have fallen significantly between 1997 and 2005, B.C. still ranked 60th in a North American comparison.

The report blames several factors for B.C.’s above-average crime rate

Criminal business organizations involved in the illegal drug trade.
Defective and/or deficient childhood development practices.
Mental disorder and fetal alcohol spectrum disorder.
High numbers of impoverished chronic, repeat offenders addicted to drugs and alcohol.
The apparent failure of the criminal justice system to punish offenders.
But while Vancouver has high property crime rates, it ranks better on violent crimes with rates below those found among major U.S. cities.

Vancouver’s violent crime rate of 391 incidents per 100,000 population ranked it eighth, behind top-ranking Quebec at 185 incidents per 100,000 population and ahead of Detroit with 716, said the report.

Vancouver ranked eighth on the homicide rate with 2.5 per population, above the national average of 1.9, but less than one-quarter of bottom ranked Detroit

how can i sue my landlord?

i have just bought premises hair salon in july and soon after in month later when is rain the water start leek in to the front of my shop so soon the clint walk in to the shop first thing they see the water raining on their head.i inform the land lord and send by my solicitor notes to say he got 1 week to fix the problem he get back to me and he said he wil send his builder so he didnt turn up (the builder) and after he said the free holder of the property have the right to fix the problem but this time they ask me to get 3 diffrent builder and get price from them so i did they find them no good even they are cheeper but stil so the landlord and free holder they deside to go with their builder they come and give estimate they are more expensive and there is further estimet in the promes the job dun but the leek stil there now my solicitor cant do anything but my business start build bad repitation and im the victim how can i sue my landlord thank you

We live together (not married) I am expecting his child in Aug – we bought our house 17 Months ago. I already owned a property which had very small mortgage (I let the flat to tennants) – I remortgaged and £120,000 went towards stamp duty, deposit and solicitors fees for our new house. I am NOT on the mortgage. I pay some utility bills (proof I live here). But there is nothing in writing from a solicitor to say I paid deposit etc. The short of it is, things are v bad between us – he has stopped giving me any money for food shopping (I already have a son of 7) I have absolutely nothing and am trapped with no where to turn. Before I used to survive on the rental income from flat but now I have to pay back almost £1,000 per month on the re mortgage. I am scared I am going to lose the flat. Can I make him pay me back the £120,000 as he promised to do within 1 year. Please hlp – Any advice would be greatly appreciated. I cry myself to sleep each night. I am trapped by this pig…

Hi, basically, I used to live in Manchester, and after i got married i moved to glasgow. I workf or a company in Manchester, have done so since before I graduated, I work from home/on the road, basically I travel around Scotland as I am based here basically finding new clients and so on. I spend around 3 weeks in Glasgow and 2 weeks in Manchester (every month to month and a half). When I’m in Manchester I stay with my mother who looks after my child and i spend most of my time in the office. Anyway I earn around £2100-£2200 after tax a month. My husband is in the uk on a spouse visa, he works in a resteraunt based in a hotel, he’s an assistant manager there and works 5pm – 12am 6 days a week, he earns around £1600 after tax a month, he looks after my son in the week days while I am working.

Anyway just giving you some background info, I have a very active and good credit history. I applied for in a mortgage in my name alone for a property in scotland,as my husband is not a british citizen we could not add him to the application although we did tell Abbey (who we applied for the mortgage from) about him and that I was married.

I am earning enough to cover the mortgage on my own so it was not really a problem not having his income on the application. We were putting down a deposit of £20700 (15%) . The property price was £138000 so basically we were getting a loan on £117300, I chose a fixed term of 36 months for which the payment was £742 which me and my husband can easily afford (we’re currently paying £650 in rent).

Anyway the loan got approved, i got an offer, we got the entry date, which was supposed to be today. Abbey initially asked for 3 months payslips which I provided to my broker he then sent them to Abbey. They approved the loan. Last Monday they rang me saying that we need more info from you so we are withdrawing the offer until we recieve this info. I got 3 months payslips, 3 months wage slips and my p60 which is all they asked for and the reason why my husband wasn’t on the application, anyway I got this to my broker for Tuesday and he then faxed them to them by Wednesday. On Wed we were told we would get a decision on Thurs, on Thurs we were told Fri, Fri we were told Mon, Mon we were told Tues, Tues we were told Wed, Wed we were told Thurs, which was yesterday the day I was supposed to transfer the deposit to my solicitor, it got to 1pm nobody knew anything, they told my solicitor they did not recieve the info, they told my broker they had to re-credit score my application as my husband is not British therefore he is my dependant, anyway at 5 pm they rang my broker and told him that my loan has been withdrawn because they cannot confirm the information that they have, and that’s all that they can tell us. The truth is nobody knows what the hell is going on in that company.

So basically they messed us around now, I am getting charged interest by the sellers untill I can arrange another mortgage. They left us with no other choice, no time, they gave us their decision at the very last minute, after offering us the loan and then withdrawing it, none of my circumstances have changed, i still do not understand what the hell happened.

Sorry for the long winded post, I just wanted some advice, are Abbey allowed to get away with this type of behavior? Can I do something about the way they have messes me around? They have stressed me out so much, it’s even worse because I am 3 months pregnant, I now feel like absolute crap, I just can’t understand what happened and they won’t tell us anything.

i received a letter about 2 months ago from a solicitors firm saying that my landlord was in arrears with mortgage, i contacted the letting agent and was told to send the letter to her, she then got in contact with me claiming that my landlords parents has sorted it out. now 2 months on i received a letter today that i thought was for me stateing that my landlord has to make a court appearence on the 15th jan with the mortgage lender as thet are going for reposession of the property, i again contacted the letting agent and again she told me not to worry as the arrears were paid off? if this is so why is there a court summons to make matters worse the landlord of the property lives overseas?? i am a single mother on my own with a 3 year old son could anyone give me some helpful advice?? thanks laura.

Hi All!

I have put in an offer and had it accepted, just under the asking price on a house which sadly is a repossession. It is not in a great state-appliances having been ripped out etc, scuff marks but nothing that can’t be fixed and the house is just the thing to at last get me on the ladder.. The seller/management company have reduced the price on the property once already-they have yet had no other offers on it.

The estate agent i am dealing with wants to keeps things ‘in house’, by using their services for conveyancing and mortgages.I am a single woman who is a first time buyer and i had a good deal with my bank on a mortgage but the agent has alluded to the fact that i may stand a better chance of avoiding more offers on the property if i use their mortgage service.The mortgage deal the estate agent offered isn’t bad(more expensive though) but i wondered if this is normal practice?

I have said i would not use in house solicitors which was seen as ok but they did recommend a local solicitor.

I am not well off, and although i know this is a risk i am still willing to walk away if higher offers (ie, over asking price), come in at the last minute.

i know the bank/management company want the money so need to sell and ensure that the sale will go through in 28days, but does anything here sound odd?

Just wondered!

been with my landlord nearly3yrs in this property1yr3months and we had a little problem with paying rent due to being skint anyway before it had got into2nd month of rent due he sent eviction letters which we had looked at and was completely illegal asking us to move by the weekend before all this last year (im a dancer as a living) he asked if he could hire me and some friends to dance for him which i declined next time i saw him he was all shaky and red in the face nothing mentioned since anyway we had a leak which was repaired by the council but damages inside werent by the landlord and there is extremely bad condensation which makes me get thrush on a regular basis which nothing was done about this was 6months ago its so bad the bed is wet to sleep on at night all they gave was a little dehumidifier the flat is unliveable and a dump now.anyway still not having paid the rent he sent a letter saying he is going to the courts to get us evicted then got a letter through from solicitors saying its going to court for rent arrears on 23rdmarch for immediate eviction went away to ireland for 5 days and left dog in flat with my dad looking after it my dad didnt open our letters anyway he went to flat to find he couldnt get in and ended up having to climb a ladder to climb through the window to get in.the landlord had sent a letter saying landlord is visiting the property the date before the day we were locked out at 2pm not for any reason just says he is visiting but after his visit he clearly locked the lock we dont and never have had a key to which they made a point of saying this lock doesnt work at beginning of my contract when i moved in there said its broken so my dad took lock off from inside and thats how its been left.that is illegal clearly and he cant just demand a visit to the flat we didnt open the letter as we were away but please help dont know what i can do because this is all surely harrassment and illegal but dont know where to start???
forgot to mention while i was still renting with him my mum put her property up for sale with him anyway due to this he had her contact details and instead of calling me before the intial eviction letter came through he called my mum up saying he is sending ‘heavys round to turf them out’ clearly hoping she’d volunteer the money as he knows her house is brought outright when she is not a guarantour or anything to do with it and she is mentally ill and vonurable… which is clear to see from meeting her.
the place is un liveable though the condition of it and has been for 5months so im suppose to continue paying like i did until i had enough of paying for somewhere that is so bad conditions due to his fault?

Hi

my mum is looking to declare bankruptcy but after a long talk with her solicitor, he said that it would be best to leave it until the company owed money files a bankruptcy against you.

she has opened up a business about 5 years ago and things didnt go too well and she tried so hard to keep it open and the debts just kept on piling up. she has been paying them reguarly until last year, she had no money to pay them back

now the landlord has gained the business property and she has been kicked out of the house too as we were all living up in the room above the business. (he sent nasty men to threaten my mother, falsely declared themselves bailiffs and that they had a warrant which they did not have)

now people are chasing after her sending her letter demanding payment. i know its bad not to pay them back but she really has been trying hard to get the business up and running, however failed miserably. she has been stressed out from all this and i was hoping to find some answers for her.

the thing is also that i was the director of the company and ive also been sent letters demanding money.
she also received a letter from the council demanding overdue council tax as well, but shes hardly living by as it is, and it is really difficult for her to even spend a pound at the moment. if she declares bankrupty, will that clear the debt with the council tax? shes living with her friend at the moment

i used up all my saving to help her business and not that i regret but, am worried that this might affect me also. do i need to declare myself bankrupt as well?
im a student whose getting student loan and altho i am in my final year, is worried because im afraid this might affect my study.

•Due to mad selling and Consumers service.
•Bad photos on the web, that I requested to be removed and still there
•Requested an estate agent to accompany viewers on every visit (not done)
•Accepted an offer on the house due to four week exchange, was told he had a Mortgage in place, I requested a copy but never got it.
•Requested his Solicitors details and never got it.
•Sold sign outside my house and it is not sold. Requested to be removed but still there.
•The tenants in the property got so upset with the agents, they stopped viewing happening because the agents where sending people own their own with no agent present, not showing up when an appointment was made and not informing them, and sending people to see the house that was requesting to see another property on the street. So I had to ask them to move so I could sell the property.
