We did not get rent adjustment (over $1000) when purchased the house?
Posted by: | CommentsThe real estate agent that used to be the managing agent for the vendor is now our managing agent for the property. They remitted all the rent without any adjustment to the vendor prior to the settlement. They told us that the vendor’s solicitor should have made an adjustment at settlement. But they did not. Our conveyancing agent was not aware that there was any rental adjustment as the contract said “vacant possession”. We had asked the realestate agent to change it, but it did not happen. How can we get our rental income from the vendor if he refuses? Whose responsibility is it to chase the vendor for the money? Did our managing agent do anything wrong?
i have paid my solicitor £350 for conveyancing. will i also need to pay for searches?

How do you get the solicitors to hurry up with the conveyancing?
Posted by: | Commentsthey’ve taken 2 months already!!! fair enough its shared ownership so theres three parties instead of the normal two but why is he taking so long? i ring up once a week religiously what else can i do??
its a fixed quote so he’s getting no more than he quoted…and i dont even think he’s worth that, lazy man!

Is the contract voidable?
Posted by: | CommentsThe cooling off period provision didn’t enclose within the sales contract of land. However, the agent orally informed the provision and both parties gave consents and signed the contract.
Is the agent’s oral statement a term of the contract and makes the contract valid?
If it is, then is the contract voidable in accordance with Conveyancing Act 1919.
I could not find any court cases in relation to this situation, could someone give me some reference?
The agent forgot to attach the provision in the contract, is this a mistake or negligence in Tort law?

My house is to be signed over in exchange for cash settlement. It states on the agreement no longer than 6 weeks but my conveyancing lawyer has just told me it could take longer, when I asked how much longer, was told indefinately.
Will Home Information Packs (HIPs) actually go ahead?
Posted by: | CommentsThis is of great relevance as our firm http://www.pintopotts.co.uk has a residential property conveyancing department and the impact of the introduction of HIPs will have big consequences for us.
One minute the papers are saying it is all systems go for Home Information Packs to come in on 1st June and next minute they are saying Gordon Brown is against them and they won’t happen or will come in as a watered down version.
Does anyone have a straight answer?

I have the full amount of money, i have done all that is nesseserry for completion. Im not going to worry if the house falls down after i have bought it, Just want to know what forms are required to complete…Is it possible to sign seal and complete in 10mins,

Do they have the right to make my parents sell the house to get their inheritence/ or pay the sons 1/3 of what the house is worth?

Thanks for all the answers. I have tried to get information about who to complain to but they don’t even give me these details! I am at a crucial point now so it would be costly both financially and timewise to change firms but it isn’t out of the question at this point.

I would need to make a deferred payment for HIP. An estate agent here in Lancashire is quoting £520.00 for a HIP (deferred payment) but I would have to use their Conveyancing solicitor, who’s charging £820 incl VAT for property selling for up to £150,000.
Any recommendations, including HIP sellers?

He said its a fraction of the price and they are all legally certified to carry out the necessary documentation? Anyone know if this is the case?
Agent taking me to court over unpaid Home Information Pack?

The agent fee came with a free (HIP).When the down turn came I quickly instructed the agent to withdraw the property and thats even before the conveyancing was done. Am I eligible to pay for somework that was not carried out. Do you think I have got any chance in court or should seek legal advice.
