The assigned main beneficiary of a will wants to sell a house in california that belonged to their father, but the other beneficiaries do not agree with this. He has threaten that he can do whatever he wants to with the property. Can he legally sell it without consent of the others?

How do I Sell/Rent/Swap My House quickly?

We have to move because of job situations. There is no company relocation. I have it listed on all of the sites I have found ForSaleByOwner, Craigslist, Domuswap, OnlineHouseTrading, Sublet.com. We are hoping to sell it rather quickly which I know is very hard in todays market. We just bought it two years ago for about $257,000. We got 100% financing and can’t afford to take drastically less than we still owe on it. It is not foreclosed or any thing like that. We can still afford to make payments, it is just that my husband is gone all week and we would like to get a place where he works so we can be together. Any websites, advice, buyers :) would be greatly appreciated. Thanks!

Thanks for the answer. Actually we have dropped the price already. We did upgrade a lot carpet, countertops, appliances, furnace, AC (some in the subdivision don’t even have one), Garage door & opener(again some don’t have them Crazy if you ask me), extended garage, basement, alarm system, and more I’m sure I forgot. Thanks, I really hope we are not stuck with a house no one will be living in soon…

laminate flooring

I have blonde laminate flooring, when it was put in, there was a small bleached-out mark on it, it has gotten lighter over the years, almost white, how can I remove it? Its about the size of half of stick of gum so its really noticeable. I had a rug over it, but now I need to sell the house, is there a crayon of some sort that can cover it?

Due to divorce, I need to sell my house. Since my life is in such a transition right now, I don’t know where I may ultimately want to live. Would it be better to rent a house versus buying if I may only be there for a year or two? I have two kids, so I would still rent a house or a townhouse so that they have enough room. I’m just afraid if I buy that I may end up losing money by potentially selling again so quickly. I appreciate your input on this.

Please help with my nightmare and here is the quick run down. i just don’t know what to do. this is in the state of Texas
My mom married a widower and they have both passed away.
mom been gone for 3 years and he has been gone for about 5 years
My Step Dad had previously married a lady that had 5 kids in a previous marriage. She died in the late 80′s.
When my Mom died i probated his and her will. He left everything to her and she left everything to me. When i tried to sell the house, the attorney said there are 5 other 50% owners. the community property laws then apparently gave everything to the children and not the spouse. Her kids got 50% of the house and the step Dad got 50% of the house. Sad because he bought and paid for it with his VA loan. Now the tax office because of the probabted will on record think I am the 100% owner and want all the taxes due from me and not the other 5. See the nightmare. I was told by the attorney that he contacted some of them and they didn’t want to sell the house and it could just rott. My apparent only way out was to petiton the court to do a force sale and take whatever I got. House is not worth much. say 30-35k.
Sad part was the real estate attorney that did the search wouldn’t take the case and my family lawyer wouldn’t touch it either. Help Me Please!!!!!!!!!
Sorry this is complicated to explain.I understand what you said but that is not what the attorneys told me. you are correct that step dad left everything to my Mom in will and her will left everything to me. i received the property in suscession of the prbabiting of the wills. I was going to do a quick cash sale of the house because i live out of town. The agents real estate attorney who did the title search after the inspection brought up the 5 kids and that they owned 50% of the house. My family lawyer who did the probating of the wills and the real estate lawyer both said that I have an undivided interest in the property. I would either have to get them to sign off or do a force sale. The real estate attorney said the 5 would not cooperate. i am not sure about the trumping part as at the time the lawyer said when the 5 kids mother who was married to my step dad first, died, the community property laws at the time gave everything to children not the spouse as it is today.

i probate both mans and moms wills with high hopes of getting house that was paid for.
i try to do cash sale of house and real estate attorney said that their are 5 others who own half of house. he contacted people and they where uncoperative. says must pursue force sale and only attorneys get money. talk to family lawyer who probabted wills and he agrees. tax office because of wills say i am 100% owner and owe all taxes. I have no idea what to do. i just want to protect my credit and not fork over lots of money i dont have. basically i got screwed trying to do what was right. could have not probated anything and let it all go.
I believe I understand what you are saying and both my attorney who probated the wills of the step father and my mother and the real estate attorney who did the title search (Suppossedly) said the same thing. When the first wife died, her 50% ownership of the house went entirely to here 5 kids from the previous marriage. He kept his original 50% of the house. I am glad you mentioned the succession laws and I will reasearch some more. So from what I am told there are 5 people who each own 10% and I have 50%. undivided interest. the first article I think says the same thing. thats the problem. the tax office just went by the will and says I am 100% and owe taxes whereas in fact I only own half. I contacted AFX titlesearch and am having the entire property title searched. Least then i can give something to the tax offic attorneys.
I guess the question is then how do i prove or disprove joint ownership with right of surviviorship. i contacted a national title search company to see what they come up with. They stated they could pove exactly who owned the property. I am going on what the real estate attorney said when I tried to sell the house shortly after probate. When he ran the title search for the insurance to sell he found there were 5 others and told me I had to have them sign off on selling the house. the only problem is he wouldn’t give me their names other than the last name. he said they refused and the place could sit and rott as far as they cared. He said I could petition the court to do a force sale of the property because of undivided interest. My attorney who probated the wills agreed with him. What makes me mad as I told the my attorney before probate the house was the only thing of value. if I can’t get it then it is not worth the time and money. He said there should be no problem.
But there was a problem apparently. To me the title search should have been done before probate by my attorney but I did not think of it until later. He said after that there was no way for him to have known and told me I would be better off letting it go back for taxes and sold at tax auction since the other 5 would not sell or buy my half interest. I tried to get both attorneys to send the letters and do a force sale two years ago but neither one would accept the task. What the real estate attorney said he didn’t know why they didn’t want to sell and that when the force sale was done and attorney fees, court costs and sale fees that no one would get any money. Figuritively speaking as the house is only worth about 30k and the force sale would be for about a cash price of maybe half that. If I had know about the other 5 I would never have probated the wills and got involved. I am out 5 grand in back taxes and attorney fees and I can’t legally do anything with the property.
I appreciate your assistance. It has weighed on me heavyily. I tried to do some good for my current family. I probabted both wills, paid the back taxes and then when I tried to sell it was oooops sorry. I just wish I would have known and think my attorney should have told me when I said the house is the only thing of value. If I dont get that then it is not worth the money. He should have told me to do a title search then to verify that the step dad had clear title then told me. I am waiting still for the title search to be completed. I know the house was purchased under his VA loan and i saw the paper saying the loan had been fulfilled with his name on it. Haven’t seen a deed. the county tax attorney took it off the docket and said that depending on when the step dads first wife passed could affect the title sucsession. I dunno realy. I am a computer dweeb.

I have a house that i currently rent out. I need to sell it quickly for personal reasons, but i still owe on the loan.

Does anyone know of a company that could help me? Im not looking to make alot of money off it, but i would like to be able to pay off the loan. I do not have the time to wait for it to sell itsself on the market, because that could take months.

quick property sales

my house has been on the market for about 5 months now we have another property which will be ready in the next few weeks and have been looking at other ways of selling i know we will loose money but are in a position we only paid 23000 for property and is now worth around 75000 we had an offer from express sale of 60000 which is the best so far out of the 1/2 dozen we have tried we are not in the position to keep the property and rent it out so we really do have to sell quick has anybody used a trustworthy company or know someone who has i would be gratefull to any advice on this matter and also the house is to small so we cant stay in it until market picks up thanks.

Need to downsize home. I own it… I bought it for 180k 1 1/2 years ago…
I just want to know this…is there something that can help me sell my house fast…Like a quick sale…and if i did do this, how much would i be expecting to loose in money… OR Isnt there a thing were you can buy other property based off of your property selling? I owe 15 years on this house that I am tired of renting and need to sell it rather quickly. I have a lifelong friend who I trust very much and have agreed to sell him the house on monthly payments until he can get his credit cleaned up or a co-signer. Without going into a long story, his credit is in a mess because of his recent divorce from an ex-wife who ran up thousands of dollars of credit card bills, and other things shortly before she left him for another man. Anyway, I know I will get my money and I know he will eventually get all this cleared up, my question is… I want to protect myself and him by making up some kind of contract that we can each sign and have notorized. What kind of information do I need to include in this? I want a fair contract that protects the BOTH of us. Please offer suggestions. Oh and please, no answers involving NOT selling the house in this manner. I am going to do this, I just need to know how to draw this up. Thank you.

it anymore he left the house in such bad repair that it cost me and my family nearly 10,grand to make it habitable for me and my kids i have been paying mortgage now for four years with no help from him but he says that if i sell the house he wants his half of profit to go to his kids i would like to sell as the area is terrible but if i give the kids his half i wont beable to buy another property due to lack of funds also he didnt pay anything towards the house repair and i feel i will be left out of pocket how can i get round this as i cant afford a solicitor and cant get a mortgage on my wages alone he also does not pay me any maintenance for the kids we lived together there for 10 yrs he had it for 3 yrs alone while i moved out but i have now had it alone for 4 years

I am relocating to antother state and I have been in my house for only a year and I need some advice on how to sell it fast. I called HomeVestors and they said they were not interested and that I havent been in it long enough.

If I cant sell it I will have to rent it out but I am not sure how to get that process started either.

Cheap house paint

cabinets, counters and sinks/fixtures. We have currently 11 cainets. We will reinstall 11- 18 depending on if we buy long units or shorter. Does contractor charge by amount of cabinets or hourly or what. What on average is the cost for this work labor wise excluding cost of cabinets? We will have floors done ourselves since we learned how to lay tile. The goal is to not spend a fortune just to sell this house but have it look nice to a new buyer.

This house was built in 1937 and these cabinets look as if theve been here since before it was built. I think they built the house around the cabinets. hehehe

Refacing these is not an option, trust me neither is paint since they are cheap yucky laminate stuff. This is the major thing keeping use from selling this house at market value so thank you your responses.

2. thoughts on floating hardwood floors in a kitchen?(would buyer like or be turned off)
3. how is labor charged?
4.suggestion to keep cost low?
