What do i do if my Solicitor Has Lost my Conveyancing File ?

I suspect my Uk solicitor of baldly advising me . I have asked for my conveyancing file ( which i am entitled to have )….. My problem is that after 7 weeks of asking for this file the solicitor says he has ” Lost It “… What Can I Do Next ???

Hire another solicitor and sue the b*****d.

Write to your solicitor suggesting that you may be forced to seek advice from the Law Society and giving him 7 days in which to rectify the matter. In no way must you threaten him, just make it clear that you need the matter resolved and that you are just informing of your intentions as a courtesy.
Afetr 7 days seek the advice of the Law Society.
They may advise you to engage another solicitor but at least they may be able to recommend a ggod one.

It depends on how old the file is. I am a conveyancer in BC Canada, and we are only required to keep files for 10 years, after that they get shredded. Ask his secretary if she can locate it by a different method other than your name, such as file number if you have it, or property address or legal description. When I file, there are ways of cross-referencing those files.

If the file has been lost and you are up to date with paying your bill, the first stage is to contact the Managing Partner of the firm concerned. The firm is required to have one and (s)he may be able to resolve things in a satisfactory way for you.

If that person is unable to assist, you can refer the whole matter to the Legal Complaints Service (link below) for a fuller investigation – including taking a view on whether you have been badly advised.
