We live in TX and the A/C in our rental house is broken. What are our rights as to how quickly this is fixed?
ByThis is the fourth or fifth time this has happened. The air conditioning unit is very old and the landlord keeps fixing the symptoms to the problem instead of just replacing the unit. It is getting very hot here in Texas and we already had to spend a weekend without A/C a month or so ago. Should the landlord have to fix the problem regardless of what day of the week it is? How quickly are they required to fix the problem. Should the landlord give us a deduction in our rent or pay for a hotel if it’s too hot to sleep here? This happened last summer, it was 95 degrees at night in the house, so we stayed with friends. We really didn’t want to leave the house unattended because we’ve had a lawnmower stolen from our backyard and the neighbors next door were stolen from on their first day moving in-but it was just too hot!

talk to your land lord tell him this is a problem every year

read your rental agreement and tell us what it say’s. He doesn’t have to fix anything unless stated. You however have the right to move out.

Actually A/C is now considered a health and safety issue which means that HUD classifies it as an emergency which would require the landlord to make the repairs within 24 hours. This being said, unless you’re on Section “8″ or unless your landlord has a government loan on the house, it doesn’t mean much. So your best recourse is to notify your landlord that you are going to put your money in escrow until the unit is replaced and then do it. Go to your local courthouse with your rent on or before the due date and they will take care of it. If your landlord still refuses to replace the unit, then a court date will be set up and a referee will hear the case from both sides. If he/she agrees that the unit needs to be replaced, then they will continue to withhold his rent money until it is done. If you do this, the landlord cannot take any action against you. But to prove your case, you’ll need to keep records of the dates it’s been down and the temperatures. Hope this helps.
